Provision on the Department for Foreign Economic Activity of Krasnodar Region

1. General provisions

1.1. The Department for Foreign Economic Activity of Krasnodar Region (hereinafter referred to as "the Department") is an executive authority of Krasnodar Region.

1.2. The Department is the successor of the Department for Economic Development, Investments and External Links of Krasnodar Region to the extent of rights and obligations determined in the present Provision and the separation balance sheet.

1.3. The Department shall be guided in its activity by the Constitution of the Russian Federation, federal laws and other statutory acts of the Russian Federation and Krasnodar Region, generally accepted principles and propositions of the international law, and the present Provision. 

1.4. The Provision on the Department, its structure and staff list shall be approved of by the Head of the Administration of Krasnodar Region.

1.5. The Department shall be controlled in its activity by the Head of the Administration of Krasnodar Region and Deputy Head of the Administration of Krasnodar Region in charge of the issues of economic development.

1.6. The Department shall perform its functions assigned in cooperation with the territorial agencies of the federal executive authorities, executive authorities of Krasnodar Region, local authorities, organizations and citizens.   

1.7. The Department shall enjoy rights of a body corporate, be entitled to open a personal account with the Department for Finance, Budget and Control of Krasnodar Region, have a seal with the image of the State Emblem of the Russian Federation and its own name, as well as the appropriate seals, stamps, and letterheads.

1.8. Legal address of the Department: 35 Krasnaya St., Krasnodar 350014, Russia.

1.9. Property of the Department shall be considered public property of Krasnodar Region and be assigned to the Department on the basis of the right of day-to-day management. The Department shall possess, use and dispose of the property assigned to it in accordance with the goals of its activity within the bounds of the existing legislation.

1.10. Activity of the Department shall be financed at the expense of the Regional budget funds.

2. Basic tasks of the Department

2.1. Basic tasks of the Department shall be as follows:

support of the public authorities, enterprises, institutions and organizations of Krasnodar Region in trade and economic, scientific and technical, cultural and humanitarian cooperation with foreign partners, as well as in attraction of investments to the most important sectors of the Region's economy;

coordination and monitoring of international and foreign economic activity of the executive authorities of Krasnodar Region and local authorities of the municipal units of Krasnodar Region, their supporting in implementation of the projects for international economic cooperation within the framework of the existing international legal agreements concluded by the Russian Federation and laws of the Russian Federation;

forecasting and analytical activity in the field of international and foreign economic cooperation of Krasnodar Region;

development of proposals and organizational activity connected with conclusion and execution of agreements between Krasnodar Region (Administration of Krasnodar Region) and public authorities, administrative and territorial units of foreign states and participation in execution of international agreements of the Russian Federation to the extent that concerns interests of Krasnodar Region, according to the established procedure;

organizational support for cooperation of Krasnodar Region with international organizations;

activity connected with the analysis and enhancement of export potential, improvement of exports structure of the Region, raising of efficiency of export-import operations of the enterprises and organizations of Krasnodar Region;

participation in carrying out of the Regional investment policy;

development and enhancement of trade and economic, scientific and technical, cultural and humanitarian cooperation of Krasnodar Region, attraction of foreign investments to the most important sectors of Krasnodar Region's economy and establishment of required organizational and economic conditions for this purpose;

ensured interaction of the Administration of Krasnodar Region with the Ministry for Foreign Affairs of the Russian Federation, Ministry for Economy Development and Trade of the Russian Federation, other federal executive authorities, and other subjects of the Russian Federation within the framework of the unified foreign policy direction of the Russian Federation;

coordination of activity of the executive authorities of Krasnodar Region relating to the issues of implementing the Decree of the President of the Russian Federation of December 17, 1997 No.1300 "On approval of the concept of national safety of the Russian Federation";

support and promotion within the Russian Federation and abroad of the image of Krasnodar Region as an economically developing and investments attractive region of Russia;

organized interaction in the field of congress-and-exhibition activity of Russian and foreign organizations, executive authorities of Krasnodar Region, and local authorities of the municipal units of Krasnodar Region within the Russian Federation and abroad.

3. Functions of the Department

3.1. For the purpose of achievement of the tasks assigned, the Department shall execute the following functions in accordance with the existing legislation:

interaction with the Ministry for Foreign Affairs of the Russian Federation, Ministry for Economy Development and Trade of the Russian Federation, other federal executive authorities, and other subjects of the Russian Federation concerning the issues relating to the field of activity of the Department;

interaction with the Federal Customs Service of the Russian Federation, Federal Frontier Service of the Russian Federation concerning the issues relating to the field of activity of the Department;

interaction with the representative offices of the Russian Federation abroad and foreign branch offices within the Russian Federation and in Krasnodar Region immediately, concerning the issues relating to the field of activity of the Department, within its competence;

interaction with the representatives of official, business, scientific and cultural circles of foreign states and international organizations concerning the issues of international and boundary cooperation and development of external economic links, within its competence;

participation in improvement of the legislation of Krasnodar Region for the purpose of supporting the development of international and interregional cooperation, and participation in development of propositions relating to the introduction of amendments to the statutory acts of the Russian Federation concerning the issues relating to the field of activity of the Department;

assistance to the sectoral executive authorities of Krasnodar Region and foreign organizations in execution of documents required for the departure from the Russian Federation and entrance into the Russian Federation;

preparation of reference and information materials on trade and economic cooperation of Krasnodar Region with certain foreign states, on prospects of cooperation development in Krasnodar Region;

analysis and forecasting of rates, proportions and efficiency of export-import operations within Krasnodar Region;

supporting enterprises and organizations of the Region in conjuncture analysis and goods and services markets prognostics in respect of certain foreign countries;

participation in preparation of agreements for international contacts and external economic links of Krasnodar Region;

promotion in external and interregional markets of the products manufactured by the enterprises anв organizations of the Region;

information and reference support of trade and diplomatic missions of the Russian Federation abroad with the data on the scope and prospects of trade and economic cooperation of Krasnodar Region with foreign partners;

analysis and study of international experience in humanitarian cooperation;

establishment and development of contacts with international social organizations of humanitarian orientation, maintenance of official contacts with scientific and cultural representative offices at the foreign states embassies within the Russian Federation;

collecting and analysis of data on congress-and-exhibition activity of Russian and foreign organizations within Krasnodar Region;

monitoring and assessment of participation effectiveness of the executive authorities of Krasnodar Region and local authorities of the municipal units of Krasnodar Region with respect to the congress-and-exhibition events in Russia and abroad;

development of draft legal acts and procedural recommendations for the executive authorities and local authorities of the municipal units of Krasnodar Region concerning the issues of congress-and-exhibition activity;

organization of international events with the participation of the executive authorities of Krasnodar Region and local authorities of the municipal units of Krasnodar Region within the Russian Federation and abroad;

development, manufacturing and distribution of information materials concerning the issues of economic development of Krasnodar Region on any media, and their promotion in Russian and foreign mass media;

approval of the cost efficiency indexes of activity of the Regional public unitary enterprises and open joint stock companies with the shares in state ownership of Krasnodar Region;

introduction of propositions to the Head of the Administration of Krasnodar Region concerning establishment, liquidation, reorganization of the lower public unitary enterprises and public institutions of Krasnodar Region, assigning of means from the Regional budget to the Department of Privity of Krasnodar Region or Regional public specialized institution "Public Property Fund of Krasnodar Region" for paying up of the contributions of Krasnodar Region to the authorized capital of the organizations to be established, according to the established procedure;

execution of functions of the founder of the lower public unitary enterprises of Krasnodar Region and public institutions of Krasnodar Region on behalf of Krasnodar Region in accordance with the current legislation in cooperation with the Department of Privity of Krasnodar Region;

introduction of propositions concerning the amount of profit share of the lower public unitary enterprises of Krasnodar Region subject to transfer to the Regional budget;

exercising of control over utilization of property in possession of the lower public unitary enterprises and open joint stock companies with the shares in state ownership of Krasnodar Region according to the established procedure, and analysis of the effectiveness of activity of the public unitary enterprises of Krasnodar Region and attraction of special organizations if necessary;

organization and holding of certification of the officials of the lower public unitary enterprises of Krasnodar Region and public institutions of Krasnodar Region.

4. Rights of the Department

4.1. For the purpose of execution of the functions assigned, the Department shall be entitled to the following:

to request and receive information and materials required for execution of the functions determined in the present Provision from the structural subdivisions of the Administration of Krasnodar Region, executive authorities of Krasnodar Region, local authorities of the municipal units of Krasnodar region, and other organizations, according to the established procedure;

to interact with the public authorities and organizations, as well as with individual persons, both within the Russian Federation and aboard, within its competence;

to attract research organizations, executive authorities of Krasnodar Region, specialists from enterprises and organizations to development of the issues within its competence, according to the established procedure;

to conduct conferences on the issues within the competence of the Department and attract officials and specialists of the structural subdivisions of the Regional Administration, executive authorities of Krasnodar Region, local authorities and other organizations of the Region, according to the established procedure;

to establish inter-departmental commissions, advisory committees and working groups in respect of various trends in its activity, and attract Russian and foreign specialists and companies as consultants of the Regional Administration;

to apply for conducting of audits in accordance with the established procedure upon approval of the appropriate agencies;

to apply to the authorized federal executive agencies with the purpose of approval of the draft agreements of Krasnodar Region with the subjects of foreign federated states, administrative and territorial units of foreign states, public authorities of foreign states, of the opening of representative offices of Krasnodar Region in the territory of foreign states, according to the established procedure.

5. Organization of activity of the Department

5.1. The Head of the Department for Foreign Economic Activity of Krasnodar Region (hereinafter referred to as "the Head of the Department") shall manage the Department. The Head of the Department shall be appointed to the position and dismissed from it by the Head of the Administration (Governor) of Krasnodar Region after introduction by the Deputy Head of the Administration (Governor) of Krasnodar Region (issues of economic development).

The Head of the Department shall take up a public position of Krasnodar Region. If appointed to the public position of Krasnodar Region, the Head of the Department shall be a citizen of the Russian Federation, have a higher professional education, either in liberal arts, speciality "Jurisprudence", qualification "Lawyer", or in  economics and management, speciality "World economy", qualification "Economist".

5.2. The Head of the Department shall have deputies to be appointed to the position and dismissed from it by the Head of the Administration (Governor) of Krasnodar Region after introduction by the Deputy Head of the Administration (Governor) of Krasnodar Region (issues of economic development). The Head of the Department shall allocate responsibilities among the Deputy Heads of the Department.

If appointed to the civil service position of Krasnodar Region, the Deputy Head of the Department (the First Deputy Head of the Department included) shall meet the following qualifying requirements: have a higher professional education, either in liberal arts, speciality "Jurisprudence", qualification "Lawyer", or in  economics and management, speciality "World economy", qualification "Economist", and a record of civil service (other public service) for at least four years or work experience according to the speciality for at least five years.   

5.3. The Head of the Department shall:

1) manage activity of the Department;

2) allocate functions among the Deputy Heads of the Department, other civil servants of the Department, and determine their authorities;

3) issue orders and other legal acts, give instructions concerning the issues of the activity of the Department and control their execution, within his/her competence;

4) approve of the provisions on the structural subdivisions of the Department;

5) within the framework of the statutory authority, execute functions of the representative of the employer in respect of the civil servants of the Department, the following included:

appoint to the position and dismiss from it civil servants of the Department, according to the established procedure;

encourage and discipline civil servants of Krasnodar Region, within his/her authority;

6) introduce proposals as to the structure and staff list of the Department;

7) approve of the estimates of income and expenditure of the Department and institutions dependent on the Department within the limits of the appropriations approved for the relevant period and provided in the Regional budget;

8) in accordance with the legislation of the Russian Federation and Krasnodar Region on the civil service, decide issues connected with the civil service with the Department;

9) introduce to the Head of the Administration of Krasnodar Region  draft legislative and other legal acts on the issues within the competence of the Department, according to the established procedure;

10) bear responsibility for preparedness activity and mobilization according to the legislation of the Russian Federation;

11) exercise other powers in accordance with the legislation of the Russian Federation and Krasnodar region.

5.4. Responsibilities of the Head of the Department during his/her temporal absence shall be executed by the First Deputy and in his/her absence - by the Deputy.
